1. Acceptance

TripEZGo (the “App”) is a mobile application developed and published by ZHONG CHENG LI (“we”, “us”). These Terms of Use (the “Terms”) form the agreement between you and us regarding your use of the App and the official website tripezgo.com.

By downloading, installing or using the App, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not download, install or use the App. You further represent that you are of legal age to enter into a contract in your jurisdiction, or have the consent of a parent or legal guardian.

In addition to these Terms, the App is subject to Apple’s Licensed Application End User License Agreement. These Terms govern matters specific to the App; Apple’s agreement governs the relationship between you and Apple.

2. Licence

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App on devices you own or control, in accordance with the applicable platform usage rules, for personal, non-commercial purposes.

The App is licensed, not sold. All rights not expressly granted in these Terms are reserved.

3. Acceptable use

You agree not to do any of the following, and not to help or permit anyone else to:

4. Paid features and subscriptions

The App may be offered free of charge and may include one or more paid features, in the form of auto-renewing subscriptions or one-time purchases.

The actual contents, plan structure, price, currency, billing period and availability of any paid feature are those displayed in the App Store at the time of your purchase, and may vary by region, exchange rate, applicable taxes or product changes. Any description in these Terms or on this website is illustrative only and is not a commitment as to price or features.

For auto-renewing subscriptions, the following general rules apply (as disclosed by the platform at the time of purchase):

5. Free trials

We may from time to time offer a free trial. The applicable plan, duration, eligibility conditions and usage limits are those disclosed in the App Store or in the App at the relevant time, and may be adjusted or discontinued by us or the platform at any time.

Unless stated otherwise, if you do not cancel before the trial ends in accordance with the platform’s rules, the trial converts automatically into a paid subscription and billing begins. Any unused portion of a free trial is forfeited when you purchase a subscription and is not refundable or creditable.

6. Cancellation and refunds

All transactions for the App are processed by Apple. To cancel a subscription, use your App Store account settings.

We cannot accept or issue refunds directly. Refund requests must be submitted to Apple under Apple’s policies (reportaproblem.apple.com), and approval is at Apple’s discretion under those policies.

7. Your content and backup responsibility

Content you create or import in the App belongs to you. We claim no ownership of it and cannot access it (see the Privacy Policy).

Precisely because we hold no copy of your content, backing up, preserving and restoring your data is entirely your responsibility. We strongly recommend enabling sync and making your own backups regularly. To the maximum extent permitted by applicable law, we accept no responsibility for corruption, loss or failure to restore data arising from a lost, damaged or replaced device, a system or cloud service failure, accidental deletion, a failed restore, software error, or any other cause.

In a co-edited trip, the travel companions you invite can view, change or delete that trip’s content, and their changes sync to every participant’s device. Whom to invite, and when to remove a companion, is your decision; we are not responsible for content changed, deleted or disclosed through a companion’s actions.

8. Data security and security incidents

We run no server that stores your trip content. Your content is stored on your device and, when you turn it on, synced, backed up and shared through Apple’s iCloud. Apple is responsible for the security of iCloud under its own terms; you are responsible for the security of your device and your Apple Account.

You should set a device passcode, turn on two-factor authentication for your Apple Account and keep your system up to date, and must not jailbreak your device or install unauthorised software. Keep the connection key shown on the App’s “Connect computer AI” page to yourself and use that feature only on networks you trust, and choose carefully whom you co-edit trips and share your location with.

We design and maintain the App with reasonable care, but no software can be guaranteed free of bugs or security vulnerabilities. We do not warrant that the App, your device, iCloud or any third-party service will be free from unauthorised access, malware, hacking or other security incidents.

To the maximum extent permitted by applicable law, we shall not be liable for any disclosure, alteration, corruption or loss of data caused by:

When we learn of a security vulnerability in the App that could affect your data, we will fix it within a reasonable time and give notice where the law requires.

9. Third-party content and services

The App may integrate with or link to third-party services, websites or content (for example services provided by the operating system platform, or external links you paste yourself). Such content is provided and controlled by third parties. We are not responsible for its accuracy, completeness, availability, timeliness or legality, and the presence of a link does not imply endorsement.

Your use of third-party services is subject to that third party’s own terms and policies, and any dispute arising from those services is between you and that third party.

10. Changes, suspension and discontinuation

We reserve the right to add, modify, suspend or discontinue any feature, content or service of the App at any time, without prior notice, and without liability to you or any third party.

Any feature referred to in these Terms is illustrative and does not constitute a commitment to provide, maintain or continue that feature. Where a change would materially reduce a paid entitlement you have purchased and which is still in effect, we will indicate this by appropriate means.

11. Disclaimers

The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties of any kind, whether express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability and uninterrupted use.

You understand and agree that:

12. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any damage arising from your use of, or inability to use, the App, or from any error, defect, crash, unresponsiveness, incompatibility, data corruption or loss, sync or backup failure, reminder or notification not appearing as expected, or incorrect or delayed display of information. Such damage includes without limitation:

The foregoing exclusions apply even if we have been advised of the possibility of such damage.

To the maximum extent permitted by applicable law, our total aggregate liability under these Terms or in connection with the App shall not exceed the amount you actually paid for the App to us or the platform in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, the exclusions and limitations in this section apply only to the extent permitted by that jurisdiction’s law. The exclusions and limitations in this section do not apply to damage caused by our intent or gross negligence, or to any liability that cannot be excluded in advance by law. Nothing in these Terms excludes, restricts or modifies any statutory right granted to you under consumer protection or other mandatory law that cannot be excluded by contract.

13. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from any third-party claim, demand, proceeding, damage, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of law, or your infringement of a third party’s rights.

14. Intellectual property

The App and its source code, interface design, icons, illustrations and copy, the “TripEZGo” name and logo, and all content of this website, are owned by us or our respective licensors and protected by copyright, trademark and other laws. Using the App grants you no intellectual property right or licence beyond that expressly stated in these Terms.

15. Termination

You may terminate these Terms at any time by deleting the App. We may terminate your licence without prior notice if you breach these Terms.

Provisions that by their nature should survive termination (including without limitation sections 7, 8, 9, 11, 12, 13, 14 and 17) remain in effect. Termination does not affect rights you hold in respect of existing subscriptions or purchases under Apple’s policies.

16. Apple-specific terms

You and we acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. (“Apple”).

17. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of China (Taiwan), excluding its conflict-of-law rules. For disputes arising from these Terms, the parties agree that the Taiwan Taipei District Court shall be the court of first instance, without prejudice to a consumer’s statutory right to bring proceedings before the court of their place of residence, or to any mandatory rule of jurisdiction.

Where mandatory law in your jurisdiction affords you stronger protection, that law prevails.

18. General

Severability. If any provision of these Terms is held invalid, unlawful or unenforceable, the remaining provisions remain in full force, and that provision shall be construed and applied in the manner closest to its original intent that is lawful.

No waiver. Our failure or delay in exercising any right under these Terms does not constitute a waiver of that right.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a transfer of business, merger or reorganisation.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App, superseding all prior related oral or written statements.

19. Changes to these Terms

We may revise these Terms from time to time. Revisions are reflected in the “Last updated” date on this page; where changes are material, we will indicate this in the App or on this website by appropriate means. Continuing to use the App after a change takes effect constitutes acceptance of the revised Terms.

20. Contact

Questions about these Terms are welcome at contact@tripezgo.com.
